Tow Truck Insurance Lorain Ohio – Coverage Scenario Part 2
In our most recent article continuing our series about the “Expected or Intended Injury” exclusion, we learned more about the history between former friends and business partners Teddy Toodletopper and Franky Fiddleflaps.
Apparently, Teddy abandoned the business relationship before it ever really took off because he felt Franky had betrayed him.
Their breakup resulted from a dispute over what to name their new towing business. Teddy wanted to call it Toodleflaps Towing, and Franky felt it should be called Fiddletopper Towing. Before a compromise could be reached, Franky went ahead and submitted the paperwork under the name “Fiddletopper Towing”, effectively cutting Teddy out of the decision.
So what happened in the intervening years after Teddy left the business partnership?
The next few years were tough for Teddy. He went from being on the cusp of opening his own business back to operating a tow truck for someone else. Now that he no longer had a business partner, he had to work to save up enough capital to start a business all on his own.
Meanwhile, Franky found a new business partner and was able to start his business despite Teddy’s departure. Seeing tow trucks around town with “Fiddleflaps Towing” decals on the sides added insult to injury in Teddy’s mind. Perhaps it also motivated him to continue saving and sacrificing in order to open a business of his own.
When at last he did open his business, a competitive rivalry immediately formed between Toodletopper Towing and Fiddleflaps Towing.
This bitter rivalry only intensified over the years as the list of grievances lengthened. First it was the name, but then it was sniping loyal customers from one another, undercutting each other’s business efforts, disparaging each other’s business when advertising their own company’s services, and so on.
The very sight of each other is now enough to throw both men into a tirade.
Now that we understand Teddy Toodletopper’s backstory, we will return to the present and begin to introduce the first coverage scenario designed to illustrate the “Expected or Intended Injury” exclusion.
